  • Do clearly indicate the type of action being taken by the school district.
  • Do include a detailed description of the proposed or refused action, ensuring clarity for the parents.

Misconceptions

Understanding the Prior Written Notice (PWN) form in Ohio can be challenging. Here are seven common misconceptions about this important document:

  • 1. The PWN form is only for evaluations. Many believe that the PWN form is solely for initial evaluations. In reality, it is used for various actions, including refusals, changes in placement, and reevaluations.
  • 2. Parents do not need to respond to the PWN. Some parents think that the PWN is merely a notification. However, it is crucial for parents to review the information and respond if they have concerns or disagreements.
  • 3. The PWN is the same as the IEP. While both documents relate to a child's education, the PWN specifically outlines the school district's actions and rationale, whereas the Individualized Education Program (IEP) details the educational plan for the child.
  • 4. The PWN is optional for schools. This is a misconception. The PWN is a legal requirement under the Individuals with Disabilities Education Act (IDEA) and must be provided whenever the school proposes or refuses an action regarding a child's education.
  • 5. The PWN can be delivered verbally. Some believe that a verbal notification suffices. However, the PWN must be provided in writing to ensure clarity and documentation of the school's actions.
  • 6. The PWN does not include procedural safeguards. Many parents think that procedural safeguards are separate from the PWN. In fact, the PWN includes information about procedural safeguards, which protect the rights of parents and children.
  • 7. The PWN is only relevant during the initial evaluation process. This is incorrect. The PWN is relevant throughout a child's educational journey, including transitions, changes in services, and other significant decisions.

By addressing these misconceptions, parents can better navigate the complexities of their child's educational rights and the processes involved.

Key takeaways

  • Understand the Purpose: The Prior Written Notice (PWN) form is designed to inform parents about actions regarding their child's educational program. It outlines what the school district proposes or refuses to do.

  • Complete All Sections: Make sure to fill out all required sections accurately. This includes the type of action taken, descriptions, and explanations for the proposed or refused actions.

  • Consider Other Options: The form should include a description of other options the IEP team considered and why those were rejected. This transparency is crucial for parents to understand the decision-making process.

  • Know Your Rights: As a parent, you have rights under the Individuals with Disabilities Education Improvement Act (IDEIA). The PWN should inform you of these rights and how to access procedural safeguards.

  • Contact Information: Ensure that the contact information for the school district representative is clearly provided. This allows parents to reach out with any questions or concerns regarding the notice.

  • Keep a Copy: Parents should retain a copy of the PWN for their records. This documentation can be helpful for future reference and discussions about their child’s educational needs.
