Article Guide

The Ohio 3011 form is a crucial document for firms seeking to provide professional engineering and surveying services in Ohio. This application is necessary for obtaining a Certificate of Authorization, which is required for both new firms and those looking to renew or modify their existing authorization. Key components of the application include a notarized Certificate of Authorization application, a notarized Firm Affidavit of Responsibility for each designated professional engineer or surveyor, and proof of registration with the Ohio Secretary of State. Additionally, firms must submit the appropriate application fee, which varies based on the type of application—whether it’s a new application, annual renewal, or a name change. It’s important to note that incomplete applications or those submitted without the correct fee will be returned, potentially delaying the approval process. Firms must also keep the Board informed of any changes in ownership or service offerings within a specified timeframe. Understanding these requirements is essential for compliance and successful operation in the state.

Your Questions, Answered

What is the Ohio 3011 form?

The Ohio 3011 form is an application for a Certificate of Authorization. This certificate is necessary for firms that wish to provide professional engineering and/or surveying services in the state of Ohio. The form can be used for new applications, annual renewals, late renewals, name changes, and for adding additional services.

What are the requirements for submitting the Ohio 3011 form?

To submit the Ohio 3011 form, you must include a notarized application, a separate notarized Firm Affidavit of Responsibility for each professional engineer and surveyor in responsible charge, and an active Ohio Secretary of State charter or registration number for your firm. If you are using a Doing Business As (DBA) name, you will need a separate registration for that as well. Additionally, the appropriate application fee must be included, which varies depending on the type of application.

What fees are associated with the Ohio 3011 form?

The application fees are as follows: $50.00 for a new application or a name change, $25.00 for annual renewal, and $37.50 for late annual renewal. Ensure that the payment is made in U.S. funds, using a check or money order made payable to the Treasurer, State of Ohio. Applications submitted without the correct fee will be returned.

How often do I need to renew my Certificate of Authorization?

Certificates of Authorization must be renewed annually by June 30. If you fail to renew by this deadline, your firm will become inactive and unauthorized to practice in Ohio. It’s essential to keep track of this date to avoid interruptions in your ability to provide services.

What happens if there are changes in my firm?

If there are any changes to your firm's name, address, or ownership, you must notify the Board within 30 days. This includes changes in partners, managers, officers, or designated professional engineers and surveyors. For name changes or additional services, a new application with the appropriate fee is required.

Can I submit the Ohio 3011 form online?

Currently, the Ohio 3011 form must be submitted in paper format. You will need to deliver the completed application, along with any affidavits and the fee, to the Ohio Engineers and Surveyors Board at the specified address. Ensure that all documents are complete to avoid delays in processing.

Is the information I provide confidential?

Most documents and records maintained by the Ohio State Board of Registration for Professional Engineers and Surveyors are considered public records. This means that the information you provide may be subject to disclosure if there is an official public records request. It’s important to be mindful of this when submitting your application.

Common mistakes

  1. Failing to complete all required fields. Every field must be filled out unless otherwise specified. Incomplete forms will be returned.

  2. Not providing the correct application fee. Ensure that the fee matches the type of application being submitted, such as new, renewal, or name change.

  3. Using a P.O. Box for the address. The application requires a physical address where professional services will be offered, not a P.O. Box.

  4. Neglecting to include the notarized Firm Affidavit of Responsibility (PES 3012) for each professional engineer or surveyor in responsible charge.

  5. Not having an active Ohio Secretary of State registration number. This number is essential for the firm and any DBA name.

  6. Forgetting to notify the Board of any changes in the firm’s name or address within the required 30-day period.

  7. Overlooking the need for a new application when adding an additional service or changing the firm’s name, along with the corresponding fee.

  8. Failing to provide truthful responses in the declaration section, which could delay the application or result in rejection.

  9. Submitting an application without the necessary signatures, including the affiant’s signature and the notary’s signature.

  10. Not being aware that a Certificate of Authorization is distinct from an individual license to practice professional engineering or surveying.

Documents used along the form

When applying for a Certificate of Authorization in Ohio, several additional forms and documents are typically required. These documents ensure compliance with state regulations and facilitate the processing of applications. Below is a list of common forms that accompany the Ohio 3011 form.

  • Firm Affidavit of Responsibility (PES 3012): This notarized document is required for each professional engineer and surveyor designated in responsible charge. It attests to their qualifications and responsibilities within the firm.
  • Ohio Secretary of State Registration: Firms must provide an active charter or registration number from the Ohio Secretary of State, confirming their authorization to operate in Ohio. This includes any DBA (Doing Business As) names.
  • Application Fee Payment: A nonrefundable fee must accompany the application, payable by check or money order. The fee varies depending on the type of application (new, renewal, late renewal, additional service, or name change).
  • Disclosure Statement: This statement outlines the necessity of providing information for statutory purposes. It highlights the potential for disclosure under public records law.
  • Notarized Affidavit: A sworn statement affirming the accuracy of the information provided in the application. It is crucial for verifying the legitimacy of the application.
  • Professional Engineer/Surveyor Registration Numbers: Each professional involved in the firm must provide their Ohio registration numbers, ensuring that they are legally recognized to practice in the state.
  • Change Notification Form: If there are any changes in the firm’s name, address, or ownership, this form must be submitted to the Board within 30 days of the change.
  • Additional Pages for Registrants: If the firm has more than four owners or registrants in responsible charge, additional pages must be attached with the required information for each individual.

These documents collectively support the application process and ensure that firms adhere to the regulations set forth by Ohio’s State Board of Registration for Professional Engineers and Surveyors. Properly preparing and submitting these forms can significantly streamline the approval process for a Certificate of Authorization.

Similar forms

  • Ohio Firm Affidavit (PES 3012): This document is similar to the Ohio 3011 form as it also requires notarization and must be submitted for each professional engineer and surveyor in responsible charge. Both forms are essential for compliance with Ohio regulations regarding professional engineering and surveying.
  • Application for Professional Engineer License: This application is used by individuals seeking to become licensed professional engineers in Ohio. Like the Ohio 3011 form, it requires detailed personal and professional information and must be submitted with appropriate fees.
  • Application for Professional Surveyor License: Similar to the Ohio 3011 form, this application is for individuals seeking licensure as professional surveyors. It also necessitates a complete application process, including fees and supporting documents.
  • Certificate of Good Standing: This document verifies that a business entity is authorized to operate in Ohio. It parallels the Ohio 3011 form in that it confirms compliance with state regulations and requires submission to the appropriate board.
  • Business Registration Application: This application registers a business entity with the Ohio Secretary of State. Like the Ohio 3011 form, it requires specific information about the business and must be filed to legally operate in the state.
  • Annual Renewal Application for Licenses: This document is necessary for maintaining professional licenses in Ohio. It shares similarities with the Ohio 3011 form as both require annual renewal and the submission of fees to continue practicing legally.

Dos and Don'ts

When filling out the Ohio 3011 form, keep the following guidelines in mind:

  • Do fill out the application completely. Every field is required unless stated otherwise.
  • Do include a notarized Firm affidavit of responsibility for each professional engineer and professional surveyor in responsible charge.
  • Do ensure the firm holds an active registration with the Ohio Secretary of State.
  • Do submit the appropriate application fee using a check or money order in U.S. funds.
  • Do notify the Board within 30 days of any changes to the firm’s name or address.
  • Don't submit an application without the correct fee or complete information; it will be returned.
  • Don't forget that the Certificate of Authorization expires annually on June 30.
  • Don't assume that a Certificate of Authorization is the same as an individual license to practice professional engineering or surveying.
  • Don't use a PO Box as the address for the firm; it is not acceptable.
  • Don't neglect to include a new application and fee if there is a name change or if adding an additional service.

Misconceptions

Misconceptions about the Ohio 3011 form can lead to confusion and delays in the application process. Here are eight common misunderstandings:

  • The Ohio 3011 form is only for new applications. This form is also used for annual renewals, late renewals, adding services, and name changes.
  • You can submit the application without all required documents. Incomplete applications will be returned. All fields must be filled out unless specified otherwise.
  • The application fee is the same for all types of requests. Different fees apply: $50 for new applications and name changes, $25 for annual renewals, and $37.50 for late renewals.
  • Notarization is optional. The application and the Firm affidavit of responsibility must be notarized to be valid.
  • A Certificate of Authorization is the same as a personal license. They are distinct; the Certificate allows a firm to operate, while individual licenses are required for personal practice.
  • You can use a P.O. Box as the firm’s address. A physical address is required; P.O. Boxes are not acceptable.
  • Only one professional engineer or surveyor needs to be designated in charge. Each full-time employee in responsible charge must fill out a separate Firm affidavit.
  • Changes in firm ownership do not need to be reported. Firms must notify the Board within 30 days of any ownership changes.

Key takeaways

When filling out the Ohio 3011 form for the Certificate of Authorization, there are several important points to keep in mind. Here are key takeaways to ensure a smooth application process:

  • Complete the Application: Ensure that every field on the application is filled out completely, as all fields are required unless otherwise indicated.
  • Notarized Affidavit: Each professional engineer and surveyor designated in responsible charge must submit a separate notarized Firm Affidavit of Responsibility (PES 3012).
  • Active Registration: Your firm must hold an active registration with the Ohio Secretary of State. This includes any "Doing Business As" (DBA) names.
