Owner agrees to notify Trainer of any and all change of addresses, emergency telephone numbers, itineraries or other information reasonably necessary to contact Owner in the event of an emergency. In the event Owner departs for vacation or is otherwise unavailable, prior to departure Owner shall notify Trainer as to what party is authorized to make decisions in the Owner's place with regard to the health, well-being, and/or medical treatment of the horse(s).

However, Trainer will not be obligated to retain and/or maintain the horse(s) in question in the event the amount of the bill exceeds the

anticipated unregistered value of the horse(s.) In the event Trainer exercises Trainer's lien rights as above-described for non-payment, this Agreement shall constitute a Bill of Sale and authorization to process transfer applications from any breed registration as may be applicable to said horse(s) upon affidavit by Trainer's representatives setting forth the material facts of the default and foreclosure as well as Trainer's compliance with foreclosure procedures as required by law. In the event collection of this account is turned over to an attorney, Owner agrees to pay all attorney's fees, costs, and other related expenses for which a minimum charge of $250.00 will be assessed.

Your Questions, Answered

What is a Horse Training Contract?

A Horse Training Contract is a legal agreement between the horse owner and the trainer. It outlines the terms and conditions under which the trainer will provide training and care for the horse. This includes fees, services provided, and the responsibilities of both parties.

What fees are involved in the training contract?

The contract specifies a monthly fee for training and board, which is due on the 1st of each month. If the payment is overdue by five days, a late fee of $10 per day will be added. Owners should also be aware that all expenses related to veterinary and farrier services will be their responsibility.

What happens if the horse dies or becomes unfit for training?

In the event of the horse's death or if it becomes unfit for training, the trainer has the option to accept another horse or terminate the agreement. If the agreement is terminated, the owner must pay all outstanding fees before leaving the facility.

Who is responsible for veterinary care?

The trainer will choose a veterinarian and farrier for routine care unless the owner requests their own. If the owner's veterinarian is unavailable, the trainer will proceed with their choice. All related costs will be the owner's responsibility.

What is the trainer's liability regarding the horse's health?

The trainer is not liable for any sickness, injury, or death of the horse, except in cases of negligence. Owners should be aware that they assume all risks associated with boarding their horse and are encouraged to obtain insurance for added protection.

Can the contract be changed or terminated?

Yes, the trainer can change or terminate the agreement with thirty days' notice. Owners must also provide thirty days' notice if they wish to remove their horse before the initial training period ends.

What should I do in case of an emergency regarding my horse?

The trainer will attempt to contact the owner for any necessary veterinary care. If unable to reach the owner, the trainer is authorized to secure emergency treatment, with all costs being the owner's responsibility.

What if I want to visit my horse during training?

Owners are encouraged to visit their horses regularly. However, visits should be scheduled in advance to ensure that the trainer can accommodate them without interrupting training sessions.

What happens if I store equipment at the trainer's facility?

Owners can store tack and equipment at no additional charge, but the trainer is not responsible for any loss or damage. Items stored are at the owner's risk, and vehicles may incur storage fees if accounts are delinquent.

What is included in the entire agreement clause?

The entire agreement clause states that this contract represents the complete understanding between the trainer and owner. No other verbal or written agreements are valid unless explicitly included in this document.

Common mistakes

  1. Incomplete Owner Information: Failing to provide all necessary details about the Owner, including contact information and any relevant background about the horse, can lead to misunderstandings. Ensure that every section of the Owner's Information Sheet is filled out completely.

  2. Neglecting Payment Details: Not specifying the payment amount or the duration of the training period can create confusion later. Clearly state the monthly fee, any applicable taxes, and the minimum training duration to avoid disputes.

  3. Ignoring Health and Safety Requirements: Omitting information about the horse's health history or failing to disclose any hazardous behaviors can put both the horse and Trainer at risk. Be transparent about any known issues or behaviors your horse may have.

  4. Overlooking Emergency Contact Protocols: Not providing an alternative contact or failing to communicate how decisions regarding emergency care should be handled can lead to delays in treatment. Always ensure that the Trainer knows how to reach you or who to contact in your absence.

  5. Missing Signatures and Dates: Forgetting to sign the contract or date it can invalidate the agreement. Review the document carefully to ensure all signatures are present and that the date is filled in correctly.

Documents used along the form

When entering into a Horse Training Contract, several other forms and documents may be necessary to ensure a smooth and clear understanding between the trainer and the horse owner. Below is a list of commonly used documents that complement the training contract.

  • Owner's Information Sheet: This document collects essential details about the horse and the owner. It typically includes the horse's medical history, feeding preferences, and any special care instructions.
  • Emergency Care Authorization: This form allows the trainer to seek emergency veterinary care for the horse if the owner cannot be reached. It ensures that the horse receives timely medical attention in case of an emergency.
  • Coggins Test Certification: A negative Coggins test is required to confirm that the horse is free from equine infectious anemia. This document is crucial for the health and safety of all horses on the premises.
  • Liability Waiver: This document releases the trainer from liability for any injuries or damages that may occur during training. It is important for protecting the trainer from legal claims related to accidents.
  • Payment Agreement: This form outlines the payment terms, including the amount due, payment schedule, and any late fees. It helps to clarify financial obligations between the owner and the trainer.
  • Rules and Regulations Agreement: This document details the rules that the owner must follow while their horse is in training. It ensures that both parties are aware of expectations and responsibilities.
  • Release of Information: This form allows the trainer to share information about the horse's training progress with the owner or other designated individuals. It facilitates open communication regarding the horse's development.
  • Media Consent Form: This document grants permission for the trainer to use photographs or videos of the horse for promotional purposes. It is important for those who wish to maintain privacy regarding their horse's representation.

Each of these documents plays a vital role in establishing a clear and respectful relationship between the horse owner and the trainer. By ensuring that all necessary forms are completed, both parties can focus on what truly matters: the well-being and training of the horse.

Similar forms

  • Boarding Agreement: Similar to a Horse Training Contract, a Boarding Agreement outlines the terms under which a horse is kept at a facility. It typically includes details about fees, care, and responsibilities of both the owner and the boarding facility. Both documents emphasize the owner's obligation to pay for services rendered and may include clauses about the facility's right to lien for unpaid fees.
  • Veterinary Services Agreement: This type of agreement specifies the terms under which veterinary services will be provided to an animal. Like the Horse Training Contract, it addresses payment responsibilities and may authorize the veterinarian to provide emergency care if the owner cannot be reached. Both documents highlight the importance of the owner's consent for medical treatments.
  • Farrier Services Agreement: A Farrier Services Agreement outlines the terms for hoof care provided by a farrier. Similar to the training contract, it typically includes payment terms and may specify that the owner is responsible for covering costs associated with the farrier's services, reinforcing the owner's financial obligations.
  • Lease Agreement for Horses: This document governs the leasing of a horse and includes terms regarding care, training, and financial responsibilities. Like the Horse Training Contract, it establishes the roles of both parties and may contain clauses about liability and risk management, ensuring that both the lessor and lessee understand their obligations.
  • Sales Contract for Horses: A Sales Contract outlines the terms of sale for a horse, including payment and transfer of ownership. Similar to the Horse Training Contract, it includes warranties about the horse's health and condition, as well as terms for liability and risk, ensuring that both parties are protected during the transaction.

Misconceptions

Misconceptions about the Horse Training Contract can lead to misunderstandings between the Trainer and the Owner. Here are four common misconceptions:

  • The Trainer guarantees specific results from training. Many believe that signing the contract ensures their horse will achieve certain training outcomes. However, the Trainer explicitly states that results depend on the horse's individual abilities and cannot be guaranteed.
  • All veterinary and farrier expenses are covered by the Trainer. Some Owners assume that all care costs will be included in the training fee. In reality, the contract specifies that Owners are responsible for these expenses unless otherwise agreed upon.
  • The Trainer is liable for any injuries or death of the horse. There is a common belief that Trainers are responsible for any harm that comes to a horse during training. The contract clearly outlines that the Trainer is not liable for such incidents, except in cases of negligence.
  • The contract can be terminated at any time without notice. Owners may think they can end the agreement whenever they choose. However, the contract requires a 30-day notice for termination, along with any applicable fees.
